Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Savora websites, mobile applications, and related services (collectively, the “Service”). The Service is operated by Nutrify Technologies Inc. (“Savora”, “we”, “us”, or “our”). By accessing or using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.

What Savora Is

Savora provides a technology platform that helps users discover and order food from participating restaurants (“Restaurants”) based on dietary preferences and information such as nutrition and allergens.

Savora is not a restaurant, food preparer, or delivery provider. Restaurants are responsible for preparing and providing the food you order, and for complying with applicable laws and regulations. Savora does not control Restaurants and does not guarantee their products or services.

Dietary, Nutrition, and Allergen Disclaimer

The Service may display nutrition information, ingredient information, allergen indicators, dietary filters, or similar content. This information may come from third parties (including Restaurants) and may be incomplete, outdated, or inaccurate.

  • Not medical advice. The Service is provided for informational and convenience purposes only and is not medical or professional advice.
  • No guarantee of safety. Savora does not guarantee that any menu item is safe for your dietary needs, medical condition, or allergies.
  • You are responsible for verification. If you have an allergy, intolerance, or medical dietary requirement, you must confirm directly with the Restaurant before ordering and consuming any food. Cross-contamination can occur even when ingredients are not intentionally included.

You use the dietary and nutrition features at your own risk.

Accounts

You may need an account to use parts of the Service. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

We may suspend or terminate your account at any time as described in Section 12.

Orders

When you place an order through the Service, you are making a purchase from the Restaurant (and not from Savora). Restaurants are responsible for fulfilling orders, including preparation, packaging, and handling.

Order availability, menu items, pricing, fees, taxes, and estimated times may change at any time and may vary by Restaurant.

Payments

Savora facilitates payments for orders through Stripe and related payment processors. By placing an order, you authorize Savora (and our payment processors) to charge your selected payment method for the order total, including applicable taxes, fees, and tips (if available).

You agree that:

  • you are authorized to use the payment method you provide;
  • you will pay all charges incurred through your account; and
  • Savora may share information with Stripe or other processors as needed to complete payments and prevent fraud.

Payment processing is subject to Stripe’s terms and policies.

Refunds, Cancellations, and Issues

Because Restaurants prepare food promptly, many orders may be non-cancellable or only cancellable within a short window.

Refunds, credits, and adjustments may be offered at Savora’s discretion to improve user experience, but Restaurants are primarily responsible for order accuracy and food quality. If you experience an issue (missing items, incorrect order, quality concerns), contact us at support@savora.ca and we may coordinate with the Restaurant.

Savora does not guarantee refunds in all circumstances.

Reviews and User Content

You may be able to submit reviews, ratings, comments, photos, or other content (“User Content”). You retain ownership of your User Content, but you grant Savora a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify (for formatting), publish, display, and distribute your User Content in connection with operating, marketing, and improving the Service.

You agree that your User Content:

  • is accurate to the best of your knowledge,
  • does not violate any law or third-party rights,
  • is not defamatory, abusive, harassing, hateful, or misleading,
  • does not contain personal information you do not have the right to share.

We may remove or restrict User Content at any time for any reason.

Restaurant Content and Trademarks

Restaurants and other third parties may provide menus, descriptions, images, and trademarks. Restaurants retain ownership of their content and trademarks. Savora does not claim ownership of Restaurant trademarks or menu content.

Acceptable Use

You agree not to:

  • misuse the Service or interfere with its operation;
  • attempt to access non-public areas or systems;
  • scrape, reverse engineer, or circumvent security measures;
  • use the Service for unlawful, harmful, or deceptive purposes; or
  • violate any applicable laws or third-party rights.

Intellectual Property

Savora and its licensors own all rights in the Service, including software, design, text, graphics, logos, and trademarks (excluding Restaurant content). You may not copy, modify, distribute, sell, or lease any part of the Service except as permitted by these Terms or applicable law.

Suspension and Termination

We may suspend or terminate your access to the Service (including your account) at any time, with or without notice, if we believe you violated these Terms or if we determine it is necessary to protect the Service, users, Restaurants, or Savora.

You may stop using the Service at any time.

Disclaimers

The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Savora disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Savora does not warrant that the Service will be uninterrupted, error-free, or that any information (including nutrition or allergen information) is accurate or complete.

Limitation of Liability

To the maximum extent permitted by law:

  • Savora will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill.
  • Savora will not be liable for any harm arising from Restaurant food preparation, food quality, allergens, contamination, foodborne illness, or Restaurant conduct.

Savora’s total liability for any claim arising out of or relating to the Service will not exceed the greater of:

  • CAD $100, or
  • the total amount of fees paid by you to Savora (excluding amounts paid to Restaurants) in the three (3) months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnity

You agree to indemnify and hold harmless Savora and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • your use of the Service,
  • your User Content,
  • your violation of these Terms, or
  • your violation of any law or third-party rights.

Disputes and Governing Law

These Terms are governed by the laws of the Province of British Columbia and the applicable federal laws of Canada, without regard to conflict of laws principles.

You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the courts located in British Columbia, and you consent to their jurisdiction.

Changes to the Service or Terms

We may change the Service or these Terms from time to time. If we make material changes, we will update the “Effective date” above and may provide additional notice through the Service. Your continued use of the Service after changes become effective means you accept the updated Terms.
